HISTORY:
WHAT IS THIS CONTRACT FOR? Construction bid award to reconstruct the Senior Center parking lot. PROJECT INFORMATION/DETAILS: The Senior Center parking lot has exceeded its useful lifespan and has been in need of replacement for nearly 10 years. This facility is used by some of the community's less mobile individuals and there are many tripping hazards that exist through the parking lot. BIDDING DETAILS: On March 24 and March 31, 2022, staff published a call for bids. On April 14, 2022 six bids were received. Premier Excavation, Inc is the lowest responsive and responsible bidder, with a bid in the amount of $565,255.22. FINANCING: The initial budget for the project was $350,000. The cost beyond the budgeted amount will be funded by $190,000 of CDBG funding and $25,255.22 of additional ARPA funds.
POLICY ISSUES:
Contracts over $50,000 require City Council approval.
PLAN COMPLIANCE:
STRATEGIC PLAN: Ensure that recreational, cultural, and educational opportunities provided by the City are equitable and inclusive. Provide programs that serve all age groups and address quantity and access to those opportunities. COMPREHENSIVE PLAN: PR Policy 1.2 Provide a variety of recreational facilities and opportunities to make recreation more accessible, attainable, and attractive for all ages and abilities of users, and to build a sense of community. Financial Comments: If the budgets are not adjusted, managing the City's resources becomes more difficult since staff would be relying on outdated revenue and expense budget information to make decisions. Also, the City would not have accurate records from which to plan and manage in the future. Finally, State Auditors could issue an audit finding if actual expenditures exceed those authorized by Council action. The City will not know the full impact of COVID-19 on the revenue and expenditures until later in the year. Departmental spending is limited to only essential expenses. If amended as proposed, the projected total Unassigned General Fund balance will be $6,143,050 (14.93%) as of December 31, 2022.

HISTORY:
Certain developments related to the City's 2021-2022 Biennium Maintenance & Operations (M&O) Budget and CIP Budget necessitate consideration of an amendment adjusting that budget. This is the second budget amendment for the second year of the biennium and includes numerous modifications to capital projects due to the ARPA funding awarded to the City since the adoption of the 2021-2022 Biennium Budget and other revenue and expense adjustments of an accounting nature. Highlights of those adjustments adding to the budget include: Revenues Increase revenue in the General Fund by $4,865,920 for the second award of ARPA funding. Increase revenue in the REET Fund by $263,630 in real estate excise tax based on updated revenue estimates. Increase revenue in the General Construction Fund by $939,500 to award the contract for First Ave Plaza construction, sleep center upgrades, and finalize the drill tower project. Increase revenue in the Drug Fund by $444,000 for a federal task force grant awarded to the City. Increase in revenue for the Transportation Benefit District Fund by $325,000 in public transportation tax based on updated 2022 revenue estimates. Expenses Increase expenditures in the General Fund by $1,419,500 for transfers to the general construction fund supporting projects. Capital Improvement Plan The Capital Improvement Plan (CIP) modifications are adjustments to revenues and expenses for new and existing projects and the closure of projects. The modifications also include cost and revenue updates based on project experience to date. Spreadsheets outlining the 2021-2022 M&O Budget adjustments and the modifications to the Capital Improvement Plan are attached for review.
POLICY ISSUES:
Amending the Maintenance and Operation Budget is an ongoing process that results in a more up-to-date fiscal plan responsive to the City's experience in terms of revenues and expenditures. It is more accurately representative of the cost of delivering services to the citizens of Walla Walla. It is a sound fiscal practice that enables managers to expend City resources as authorized by the Council and make decisions related to the delivery of City services and facilities. Additionally, the State prohibits the expenditure of funds over the limits authorized by the Council.
PLAN COMPLIANCE:
STRATEGIC PLAN: The June 2021-2022 budget amendment addresses all four Key Focus Areas of the Strategic Plan. Livability: what the City of Walla Walla focuses on to execute the organization's mission of enhancing the quality of life in Walla Walla. Economic Health: The City's financial stability through sustainable revenue sources, attracting new businesses and shopping opportunities, and support a strong economy through diverse employment sectors. Safe Community: Organizational readiness around emergency management, infrastructure stability (maintenance/ repair/multimodal), and overall community safety. High Performing Organization:The City will develop a culture of continuous improvement, collaboration with organizations and partners within the community, and well trained and supported workforce.
ALTERNATIVES:
Direct staff to develop alternative budget adjustments and/or a Capital Improvement Plan as desired by the Council, which provides authority to meet audit requirements.
STAFF RECOMMENDATION:
Approve the ordinances that amend (1) the 2021-2022 Maintenance and Operations Budget; and (2) the Capital Improvement Plan.

HISTORY:
Federal funding agencies require that projects be listed in both the Walla Walla Valley Metropolitan Planning Organization's (WWVMPO) regional transportation plan and the Statewide Transportation Improvement Plan (STIP) to be eligible for grant or loan consideration. The City's Comprehensive Transportation Plan (CTP) is the basis for City projects to be included into the regional transportation plan, and ultimately the STIP. The CTP is divided into two main sections: 1) Active Program - These projects have a higher likelihood of occurring during the six-year timeframe of the CTP. These are the only projects considered for the inclusion on the STIP. 2) Long Range Program - These are priority projects that do not have an identified funding source, and are not likely to be funded within the six-year term of the CTP. As projects are completed, or authorized for construction by the funding agency, they drop off the six year CTP. Projects included in the previous 2022-2027 CTP which have been completed, are under construction, or have otherwise been removed from the active list include: 1. Poplar Street - Colville to 5th (currently under construction) 2. 9th Avenue Ped Improvements - Orchard to RR Tracks (funding will be obligated in 2022) 3. POLICY ISSUES:
RCW 35.77.010 requires that all cities, towns, counties, and transit agencies create, annually update, and formally adopt their six-year Comprehensive Improvement Plan (CTP) as part of a coordinated transportation improvement program. The City's updated plan is included with those of other Washington local agencies for the Statewide Transportation Improvement Plan (STIP). RCW 35.77.010 also requires that a public hearing be held by the Council prior to considering adoption of the CTP.
PLAN COMPLIANCE:
COMPREHENSIVE PLAN: TRANSPORTATION GOAL 1 - Promote and develop transportation systems that support and enhance the movement of people and goods to ensure a prosperous economy. TP Policy 1.1 - Improve safety for walking, biking, transit, motor vehicles, and freight at high collision locations identified through data-driven safety analysis. TP Policy 1.2 - Enhance existing and new crossings for pedestrians and bicyclists where appropriate. TP Policy 1.3 - Provide facilities for all modes of transportation. TRANSPORTATION GOAL 2 - Provide for and improve the safety and security of transportation users and the transportation system. TP Policy 2.1 - Improve the efficiency, safety, access, capacity, and reliability of the freight system. TRANSPORTATION GOAL 3 - Provide all users with complete streets that connect the City of Walla Walla’s neighborhoods, parks, schools, employment centers, and retail areas. TP Policy 3.1 - Implement complete street projects where feasible to improve the transportation experience for all modes of transportation. TP Policy 3.5 - Improve multimodal connections to community facilities and amenities (e.g., neighborhoods, parks, schools). TRANSPORTATION GOAL 4 - Maintain, preserve, and extend the life of the City’s transportation infrastructure. TP Policy 4.2 - Maintain the existing transportation infrastructure to preserve the intended function and extend the useful life. TRANSPORTATION GOAL 5 - Design and construct transportation facilities in a manner that enhances the livability of the City of Walla Walla and health of its residents. TP Policy 5.1 - Protect the scenic, natural, and cultural resources as well as the historic character of Walla Walla. TP Policy 5.1 - Create a well-connected network of streets, paths, and transit service to provide active transportation options. TP Policy 5.8 - Where determined to be needed by the City Engineer, implement neighborhood traffic management using techniques such as curb extensions, median islands, diverters, speed humps, and traffic circles to reduce traffic speeds and enhance safety. TRANSPORTATION GOAL 6 - Maintain the predictable movement of goods and people throughout the City of Walla Walla to relieve traffic congestion and improve reliability for freight. TP Policy 6.1 - Implement new or improved transportation connections to enhance the efficiency and reliability of the multimodal transportation system. TP Policy 6.2 - Develop new and preserve existing arterial and collector corridors to provide alternative routes to US 12 and SR 125 for local traffic. TP Policy 6.3 - Improve travel reliability, safety, and efficiency with system management solutions (e.g., coordinated traffic signal timing).
ALTERNATIVES:
Council will need to adopt the proposed Comprehensive Transportation Plan (CTP) for 2023-2028 as presented, or with modifications as they find appropriate, to meet the WWVMPO and State deadlines. Modifications can always be completed beginning in early 2023 after the initial submittal to the MPO has been approved.
STAFF RECOMMENDATION:
Staff recommends Council hold a public hearing and adopt the proposed 2023-2028 Comprehensive Transportation Plan.

HISTORY:
January 22, 2002: The City received a 10% Notice to Commence Annexation petition submitted by the property owners of land located at 700 McBeth Road. The future land use designation for the subject properties is Residential and implementing zoning designation would be Neighborhood Residential. The proposed annexation boundary is contiguous to the City limits. March 9, 2022: The City Council met and determined to accept the annexation boundary, as proposed by the petitioners, through Resolution 2022-58. April 19, 2022: Staff received a sufficient petition signed by owners of the properties, which is not less than sixty percent (60%) of the assessed value of the proposed annexation area. The petition has been sent to the County Assessor's office for sufficiency of signature determination and the 60-day notice to taxing districts, via certified mail and email, was provided as required by RCW 35A.14.801. The City Council on May 25, 2022, set June 22, 2022, as the public hearing date via Resolution 2022-70. A Public Hearing notice was provided, in accordance with Walla Walla Municipal Code Section 20.02.080, as follows: Mailed to adjacent property owners and property owners within the annexation boundary – May 31, 2022. Posted in three locations within the annexation boundary as required by RCW 35A.14.130 – June 3, 2022. Published in the Union Bulletin on June 2, 2022. Posted on the City's website on June 2, 2022. The public hearing scheduled for June 22, 2022, is for the City Council to gather public comment on the proposed annexation and then determine whether to approve or not approve the annexation.
POLICY ISSUES:
Area Characteristics and Potential Impacts: Land Use Designations/Zoning - The proposed zoning applied to the annexation area is Neighborhood Residential. The comprehensive plan (and any amendments) is adopted by the City Council. Future development of the land would follow the applicable zoning designation and the permitted uses outlined in the Walla Walla Municipal Code. Housing- The Regional Housing Action Plan, adopted by City Council via Ordinance 2021-23, states the need for additional housing with the following: “The Walla Walla Region should plan to add approximately 4,685 net new housing units over the next 20 years." [... and] “Based on the residential capacity analysis and this housing needs assessment, the following conclusions are made: [...] Walla Walla Urban Growth Area (UGA) : the projected 20-year housing need of 3,570 dwelling units is below the potential Urban Growth Area capacity of 3,740 dwelling units… It is recommended that the [City of Walla Walla ...] ensure that new housing density can be optimized within current Urban Growth Area's..." This annexation of the subject property will allow for new housing and accomplish the recommendations within the Regional Housing Action Plan. Streets - Connectivity to the subject property is from Whistling Duck Road and McBeth Road. Whistling Duck Road enters onto the west property line and McBeth Road enters at the Southeast corner of the subject property. Future subdivision of the subject property will require two access points into the development under the provision of Walla Walla Municipal Code 19.30.030 B. 2. “A subdivision of fifteen or more lots shall have a minimum of two access points”. Accessing from Whistling Duck Road or McBeth Road, with the current number of existing lots on the roads, would require compliance with the code provision. Future development, utilities and driveways will be required and include applicable street and frontage improvements. Sidewalks connectivity to Prospect Point Elementary and Walla Walla High School is provided along Whistling Duck Road, via Roadrunner Lane, to Cottonwood Road. Annexation and future development of the subject property would allow school children residing along McBeth Road, Magnolia Drive, Kendall Road and South Wilbur Avenue an alternative route to Prospect Point Elementary School and the western campus of Walla Walla High School. Future development applications for the subject property, following annexation, will be subject to review under the State Environmental Policy Act (SEPA). Additionally, a Traffic Impact Analysis (TIA) may be required to determine the development’s proportional share of warranted offsite improvements and to review the distribution of traffic. Utilities - There are existing utilities within Whistling Duck Road, with an eight-inch water line and eight-inch sewer line. The proposed annexation area lies within the Cottonwood Trunk System service area. The City of Walla Walla installed the Cottonwood Trunk (Water and Sewer) System Lines in 2001, which was funded by the City Utilities because private developers could not carry the initial cost of such improvements. This water and sewer trunk line was installed in anticipation of future development within the Urban Growth Area and the Cottonwood Trunk System Special Charge was passed by ordinance 2001-10. Police - The proposed annexation area includes the existing residential uses. With mutual aid agreements, the Walla Walla Police Department would respond to an incident within the area today. The Walla Walla Police Department would become the primary responder if the annexation is approved. There is potential for new residential development in the annexation area. Fire - The area currently being considered for annexation is within the eight-minute response time zone for a City of Walla Walla Fire Department (WWFD) engine response. Currently, this area is served by Walla Walla County Fire District #4 (WWCFD#4). The City of Walla Walla and WWCFD#4 are signatories to a county-wide mutual aid agreement. The mutual aid agreement has no funding attached and is in place for the rare occasion an agency’s available resources are not adequate to manage an incident. The City has entered into an annexation mitigation agreement with WWCFD#4 to address the financial impacts to the District and their ability to maintain its current service level to the portion of the District that remains after an annexation has become effective. The six-year agreement is on a sliding scale. The City agrees to pay the District 100% of the property tax revenues (from the annexation area) the first year the annexation becomes effective, 80% the second year, 60% the third year, 40% the fourth year and 20% the fifth year. The District would continue to respond into the annexed area until the end of the mitigation agreement. Currently, the City has a Class “3” rating for fire protection from Washington Survey and Rating Bureau (WSRB). Residents in the area to be annexed will benefit from a lower fire rating per the Washington Survey & Rating Bureau (WSRB). Insurance companies base their fire insurance premiums partly on the rating of a jurisdiction. Sanitation - Recycling will be available to residential customers, if the annexation is approved. The City contracts with BDI for recycling services. BDI will continue to provide sanitation service for 138 months (or 11 ½ years) from the annexation effective date, if the annexation is approved. At the end of the 138 months, the City would assume sanitation service. Stormwater - Only developed parcel(s) will be assessed a stormwater utility fee. Census - A census will be required with this annexation, if approved, with the existing residences. The census must be completed within 30 days of the annexation effective date.
PLAN COMPLIANCE:
STRATEGIC PLAN: Key Focus Area - Livability; Strategic Objective 1 - Address Housing Crisis in Community; Initiatives - Incentives to support diversity of housing types, and Implement the Regional Housing Action Plan Policy Recommendations. COMPREHENSIVE PLAN: As identified in the Countywide Planning Policies and the City’s Comprehensive Plan, the expectation is that the urban growth area will be annexed into the city. The City plans for the urban growth area in how to provide utility services and plans for other infrastructure improvements such a future road connections. Walla Walla Comprehensive Plan – Walla Walla 2040 LU Policy 1.2: Annex and provide services to all lands within the Urban Growth Area. CFU Policy 2.2: Provide utility services to areas of the city and UGA based on the following criteria: New subdivisions must connect to utilities Proposed new residences within 300 feet of a sewer main must connect to the sewer. A proposed residence must connect to the public water system if the lot does not currently have an approved well. Any new well proposed must follow the Walla Walla Municipal Code. Property within the UGA shall annex prior to receiving city utilities. County Wide Planning Policy 2.6.2.3.6, Appendix G: Urban growth management agreements shall include a method for sharing net revenues, services and expenses, if appropriate, in annexation of significantly developed residential, commercial or industrial areas through a phased program established for a set period of time. Compensation formulas shall address revenue sources eligible for sharing and take into account shifts in the cost of service obligations. If the cost of service exceeds the amount generated from annexation areas, excess shall be deducted from any ongoing payment previously established. Cross jurisdictional equity should be considered for city to city interactions as well as city to county. County Wide Planning Policy 2.6.2.3.8, Appendix G: Each city shall designate a potential annexation area. Within this area the city shall adopt criteria for annexation and a schedule for provision or urban services and facilities within the potential annexation area. County Wide Planning Policy 2.6.2.3.9, Appendix G: A city may annex territory only within its designated potential annexation area. All cities shall phase annexation to coincide with the ability to provide a full range of urban services to areas to be annexed. County Wide Planning Policy 2.6.2.3.10, Appendix G: Undeveloped urban areas should be annexed to adjacent cities when urban services become available or are proposed to become available concurrent with development. Walla Walla County Comprehensive Plan - Amended August 5, 2019: Policy LU-8.5: Encourage annexation of significantly developed residential, commercial, or industrial areas within the UGAs.
ALTERNATIVES:
At the conclusion of the public hearing, the City Council will determine whether to approve or not approve the proposed annexation.
STAFF RECOMMENDATION:
1. The area annexed can be served by existing municipal services. 2. The area annexed would assume the City zoning designation of Neighborhood Residential consistent with the land use designations adopted through the Comprehensive Plan. 3.The annexation area adopts the City’s existing indebtedness.

HISTORY:
In 2003, the Washington State Legislature passed the Municipal Water Law to address the increasing demand on the state's water resources. The law established that all municipal water suppliers must use water more efficiently in exchange for water right certainty and flexibility to meet future demand. The Legislature directed the Department of Health (DOH) to adopt an enforceable Water Use Efficiency program, which became effective on January 22, 2007. The previous goals were adopted by Council in 2016 by Resolution 2016-096. The proposed goals were presented to the Water/Wastewater Advisory Committee on March 16, 2022 and received unanimous support from the Committee. The goals were then presented to Council at the May 9, 2022 Work Session. 2023-2028 Proposed Water Use Efficiency Goals Supply Side S1) Meter Testing Program S2) Capital Improvement Program - replacement of failing distribution piping S3) Leak detection and repair S4) Reduce water loss by 1% per year Demand Side D1) Leak notification to customers D2) Customer portal
POLICY ISSUES:
Per WAC 246.290.810 and 246.290.830, WUE goals must be updated every six (6) years. Previous goals were adopted by Council in 2016. Updated goals must be adopted by December 31, 2022. These goals align with the City's adopted Water System Master Plan, which established a goal of reducing non-revenue water by 1% per year.
PLAN COMPLIANCE:
COMPREHENSIVE PLAN: Economic Development Goal 2 Walla Walla has high-quality infrastructure to support economic development. ED Policy 2.1 Provide the infrastructure needed for business and industries to locate in Walla Walla, including utilities, transportation connections, and suitable land capacity. Capital Facilities and Utilities Goal 1 Walla Walla’s capital facilities and utilities are well maintained and up-to-date to meet the demands of growth and economic development. CFU Policy 1.1 Maintain updated plans for the provision of public utility services. CFU Policy 1.2 Monitor all public or private water systems; regularly maintain public systems. Capital Facilities and Utilities Goal 5 The sound fiscal management of government services and facilities promotes a transparent and collaborative relationship between government and residents. CFU Policy 5.1 Plan for rehabilitation of the City’s utility infrastructure to ensure safe, reliable, and efficient service.
ALTERNATIVES:
Council could provide direction to staff to consider other goals or modify the proposed goals.
STAFF RECOMMENDATION:
Approve a Resolution adopting updated Water Use Efficiency Goals for 2023-2028.

Brief Summary of Requested Action: City Council to review the recommendation for approval from the City of Walla Walla Planning Commission and render a decision for the Shoreline Substantial Development Permit for the Walla Walla Fire Department Training Center classroom and associated site developments.

HISTORY:
March 3, 2022: The City of Walla Walla Fire Department submitted a Shoreline Substantial Development Permit for the placement of an approximately 1800 sq ft. classroom building and associated training facility site improvements and props at the existing Walla Walla Fire Department Training Facility. March 11, 2022: The Notice of Application notification process was completed, as required by Walla Walla Municipal Code 20.14.065. The Notice of Application was circulated. April 6 and April 13, 2022: Notice of Application publish dates (two dates required by City Shoreline Master Program) due to error by the Walla Walla Bulletin. No comment letters were received. May 19, 2022: The Notice of Public Hearing notification process was completed, as required by Walla Walla Municipal Code 20.14.085. June 6, 2022: The City of Walla Walla Planning Commission conducted a Public Hearing on the request. The hearing was open for public comment. No public was in attendance at the meeting or via zoom. Thus, no public comment or testimony was received. Deputy Fire Chief Knowles provided testimony on the project and use of the training facility. The Planning Commission concluded the Public Hearing and recommended approval of the Shoreline Substantial Development Permit on to City Council.
POLICY ISSUES:
Policy issues are contained within the Staff report to the Planning Commission.
PLAN COMPLIANCE:

Capital Facilities and Utilities Goal 2 - Capital facilities and utilities are located in such a way as to provide safe and efficient service to all residents. Capital Facilities and Utilities Policy 2.1 - Ensure that City-provided community facilities and services are appropriate for the size and composition of the population they serve. Capital Facilities and Utilities Policy 2.5 Situate emergency service facilities to maximize ease of access and minimize response time.
ALTERNATIVES:
The City Council may decide to approve, approve with modifications, deny, or remand the request back to the Planning Commission for further consideration.
STAFF RECOMMENDATION:
Approve the Shoreline Substantial Development Permit as recommended by the City of Walla Walla Planning Commission.
CITY MANAGER COMMENTS:
Approved for City Council action.
