HISTORY:
This item was discussed in City Council Work Session on June 24, 2024. WHAT IS THIS CONTRACT FOR? Demolition and reconstruction of the planters and sidewalks in front of City Hall. The project will also include construction of concrete seat walls, stairs, storm water drainage modifications, handrails, new flag pole and sign. WHY IS IT NEEDED? The existing planters have been damaged by the trees growing in them and are no longer able to be repaired. The sidewalks in front of City Hall have been identified as not meeting ADA compliance. BIDDING DETAILS: The City published a notice calling for bids on September 5, 2024, in the Walla Walla Union Bulletin. On September 25, 2024, the City received six (6) responsible bids. See attached bid abstract for details on the bids received. The lowest responsive and responsible bidder was Jones Concrete & Excavation, with a bid of $221,422.00. This engineer's estimate for the project was $280,228.00.
POLICY ISSUES:
Contracts greater than $50,000 require Council authorization.
PLAN COMPLIANCE:

WHAT IS IT: The City of Walla Walla, Technology Services Department applied for the State Local Cybersecurity Grant Program (SLCGP) in May of 2024 and were recently approved and awarded funding for two cybersecurity related projects. Both projects will be implemented in 2024. WHY: The Technology Services Department is leveraging the SLCGP to improve its cybersecurity posture. COST: There will be no cost to the City for Project #1. Ongoing costs for Project #1 will be $5,000/year and is included in the 2025 and 2026 biennium budget. There will be no cost for Project #2 implementation. Ongoing costs for Project #2 will be $11,240/year and is included in the 2025 and 2026 biennium budget.
POLICY ISSUES:
The grant award amount is over $50,000 and requires City Council approval for City Managers' authorization of the grant.

HISTORY:
Ordinance 2023-27 established the 2024 rates. The proposed 2025 rates were prepared in accordance with the recycling collections contract authorized by Resolution 2023-117.
POLICY ISSUES:
Municipal Code 8.20.030 requires residential recycling. The proposed 2025 rates include a $0.75 City overhead/administrative charge for the costs associated with administering, billing, and managing the program. The option to include City overhead with the recycling rates was recommended to Council at the September 9, 2024 work session discussing the cost of service. The findings, priorities, and goals in RCW 70A.205.005 state that: (5) Source separation of waste must become a fundamental strategy of solid waste management. Collection and handling strategies should have, as an ultimate goal, the source separation of all materials with resource value or environmental hazard. (6)(a) It should be the goal of every person and business to minimize their production of wastes and to separate recyclable or hazardous materials from mixed waste. (b) It is the responsibility of state, county, and city governments to provide for a waste management infrastructure to fully implement waste reduction and source separation strategies and to process and dispose of remaining wastes in a manner that is environmentally safe and economically sound. It is further the responsibility of state, county, and city governments to monitor the cost effectiveness and environmental safety of combusting separated waste, processing mixed municipal solid waste, and recycling programs. (c) It is the responsibility of county and city governments to assume primary responsibility for solid waste management and to develop and implement aggressive and effective waste reduction and source separation strategies. [...] (8) The following priorities for the collection, handling, and management of solid waste are necessary and should be followed in descending order as applicable: (a) Waste reduction; (b) Recycling, with source separation of recyclable materials as the preferred method;
PLAN COMPLIANCE:

Section 3.3.1.1 Goals and Objectives • Work toward reaching a recycling rate of 50% by 2023. • Continue to encourage and educate residents and businesses to compost and recycle. GREENHOUSE GAS POLICY (Resolution 2012-31): Continue to promote and expand recycling programs...improved management of waste handling, reductions in waste generation, and expansion of waste diversion programs.

Financial Comments: Resolution 2024-027 provided the City Manager the authority to make amendments to the Consor contract of up to 10% of the contract value ($124,037). Additional contracting authority beyond the amount authorized by Resolution 2024-027 may be needed for additional (out-of-scope) work on the project. The reason why additional authority may be needed is because Consor may be able to absorb the cost of some of the additional work within their original not-to-exceed contract amount. Supplemental work items include: Additional right-of-way acquisition services include appraisal preparation, review, and negotiation services. Additional topographic surveying is needed for the project. Additional archaeological investigation. The traffic analysis for Highland and Taumarson. Design of the compact roundabouts at Highland and Taumarson. The sum of these items is anticipated to approach the authority granted by Resolution 2024-027, leaving little, if any, authority to address other needs. If authorized, the new total authority would be the sum of $124,037 plus an additional $75,963 = $200,000.

HISTORY:
The design contract with Consor was authorized in February 2024 by Resolution 2024-027. Design is presently at 60%. Construction is anticipated to begin in the spring of 2025. Numerous changes have been made during the design process to address concerns received during the public involvement process forming the Tax Increment Financing Area (that provides the funding for the Myra Road extension project). Addressing these changes is the primary reason additional authority is needed.

HISTORY:
WHAT IS THIS AMENDMENT FOR? Ecology is requesting additional water quality and pumping data for the Well 5 Aquifer Storage and Recovery (ASR) project. Work includes: Prepare a Quality Assurance project Plan (QAPP) for the well pumping step test Perform a step-rate pumping test Monitor physical water quality parameters Provide a technical memo summarizing all rehabilitation efforts, biochemical profiling, and step-rate test Prepare a conceptual hydrogeologic model consistent with the requirements of WAC 173-157 CONTRACT HISTORY: Resolution 2019-112 (September 25, 2019), $187,826 – Original Contract for ASR services. Resolution 2020-126 (December 2, 2020), $45,950 – Amendment #1 – Sanitary control area assistance and well disinfection. Resolution 2021-136 (October 13, 2021), $333,422 – Amendment #2 – Well 5 ASR feasibility study. Resolution 2022-071 (Emergency Declaration, May 24, 2022), $81,715 – Amendment #3 – Well 5 casing failure. NA (February 2, 2024), $0 – Amendment #4 – Extended the contract termination date. WHY IS A CONSULTANT NEEDED FOR THIS WORK? The ASR application process in Washington is very complex (it took the city 16-years to complete the process for Well #1 and #6) and necessitates water quality and quantity testing and numerous reports prepared and submitted by a licensed hydrogeologist prior to the Department of Ecology approving and issuing an ASR operational permit. This scope of work provides the additional analysis requested by Ecology to make a determination of feasibility for Well #5 to be converted to and operate as an ASR well. IS THE COST FAIR AND REASONABLE? City Staff reviewed the scope and fee and found it to be consistent with past ASR work. The Department of Ecology also reviewed and accepted it as fully grant eligible in accordance with the Instream Restoration Grant. BACKGROUND/HISTORY: The City's primary source of drinking water comes from the Mill Creek watershed, however the city also has seven deep basalt wells that are used to supplement, or in cases of emergency, serve as a back-up to Mill Creek surface water. To counter declining groundwater levels in the 1990s, the city began pursuing an Aquifer Storage and Recovery (ASR) program. The program injects treated surface water back into wells during allowable periods of surplus surface water. The City has operated an ASR program using Well #1 since 1999 and Well #6 since 2003.
POLICY ISSUES:
Contract amendments greater than $50,000 require Council authorization. To support improving and expanding (or not) the Aquifer Storage and Recovery program, which helps ensure water availability for city residents. This project is identified in the adopted 2021-2026 Capital Facilities Plan. Funding is provided by an Ecology Grant. OTHER COUNCIL ACTIONS RELATED TO THIS ITEM: Resolution 2021-135: Authorized acceptance of a grant for Well 5 Rehabilitation and Aquifer Storage and Recovery (ASR) Feasibility Study in the amount of $584,564.00.

Initial receipt of revenues appear to be trending to 2019 levels and therefore staff elected to use a conservative approach using the 2019 revenues and to use reserves to fund the applicants and still maintain an estimated 15% fund balance.

The Lodging Tax Advisory Committee (LTAC) met on Monday, September 30, 2024, at 10:00AM to discuss the requests. The committee allowed applicants to present for two minutes regarding their applications and answer follow-up questions from Committee members. On October 7, 2024, at 10:00AM the LTAC met again to finalize recommendations for 2025-26 funding allocations.

If different rates are adopted for recycling that do not include the $0.75 overhead, the rates proposed herein for Sanitation will need to be re-evaluated.

HISTORY:
WHY DO RATES NEED TO BE ADJUSTED? To ensure the funds remain financially self-sufficient. To provide funding operations/maintenance. To keep up with inflation and other cost increases. BACKGROUND: The last major review of Sanitation rates was completed in 2017 (for 2018-2023). A 3% increase was adopted for 2024. PROCESS: In 2023 an updated Landfill Master Plan was completed to identify capital projects for the next planning period (2025-2029). In September 2023, the Landfill Master Plan was completed. On January 10, 2024, Council authorized a contract with FCS to prepare financial plans for the Landfill and Sanitation Funds. On June 10, 2024, City staff and FCS presented various Landfill capital improvement program (CIP) options to the Council Finance Committee for input. On August 1, 2024, City staff presented revised Landfill capital improvement program (CIP) options to the Solid Waste Advisory Committee for input. The SWAC voted in support of the 6.5% annual (2025-2029) increases recommended by FCS and Staff. On August 12, 2024 (Council Work Session), City staff and FCS presented rate options and recommendations to Council. On September 9, 2024 (Council Work Session), City staff and FCS presented the COSA for Landfill, Sanitation, and Recycling to Council. On September 16, 2024, City staff presented cost of service options for Green Waste Collection to the Council Finance Committee. On September 25, 2024, Council adopted rates for Landfill (2025-2029).
POLICY ISSUES:
RCW 35A.21.152 requires forty-five days' notice prior to the proposed effective date of the rate increase for solid waste collection. SANITATION: Under current policy (Ordinance 2023-19), 64-gallon garbage containers are only available to green waste subscribers. A rate has been developed and included in the proposed Sanitation rate schedule to remove that requirement and make 64-gallon containers available to all residential customers. Key considerations of this change: The City does not carry a large inventory of 64-gallon containers (~500 on hand). If adopted as proposed there may need to be a waiting period (waitlist) to begin the service to allow for ordering and delivery of the containers (6-8 weeks). If a significant number of customers switch from 96-gallon containers, the City may end up with a surplus of 96-gallon containers. There might be a revenue impact on Sanitation, which may require reassessing rates in the future. The proposed 2025 rate for a 96-gallon residential garbage service is $28.52 per month; the proposed 2025 rate for a 64-gallon residential garbage service is $21.85 per month. GREEN WASTE COLLECTION SERVICE: Green waste collection is an optional (subscription-based) service that operates from March through November. At the September 9 work session presentation Council requested staff develop a lower cost of service recovery option for Green Waste collection. The proposed rates target recovery of 70% of the cost of service for the green waste collection service. The current (2024) rate is $26.27 per month for a 96-gallon green waste container; the proposed (2025) rate is $24.96 per month increasing at 4.75% annually thereafter.
PLAN COMPLIANCE:

Enhance and improve the overall efficiency of waste collection and disposal of solid waste. • Continue to evaluate tipping fees as related to the true cost of operations including closure and post-closure costs associated with the Sudbury Regional Landfill. PREVIOUS COUNCIL ACTIONS RELATED TO THIS ITEM: Ordinance 2023-19 – Set Sanitation rates for 2024. Resolution 2024-06 – Authorized a contract with FCS for Solid Waste Financial Planning. Ordinance 2024-18 – Adopted Landfill rates for 2025-2029.

HISTORY:
2024 Amendments to the Walla Walla Comprehensive Plan Land Use Map and amendments to the Official Zoning Map (rezone), as recommended by the Planning Commission. The proposed amendments to the Comprehensive Plan Land Use Map and Official Zoning Map Amendments (hereafter referred collectively as “Map Amendments”) are part of the annual Comprehensive Plan Amendment and Official Zoning Map application and docketing cycle/schedule as described in Walla Walla Municipal Code Chapter 20.48. The City received two privately initiated applications in 2024. The first application is from Mr. Mark Houk. The other application was withdrawn, by the applicant, prior to review by the Planning Commision. The Houk application is for approximately 2.5 acres of property that is located west of 1014 South 9th Avenue. This area is generally across the railroad tracks from the Dayl Graves automotive dealership and Grocery Outlet. The current Comprehensive Plan Land Use Map Designation is Residential and the proposed Land Use Map Designation is Commercial. The current Zoning Map Designation is Multi-family Residential and the proposed Zoning Map Designation is Highway Commercial. The Houk property is currently vacant, of any substantial structures, and was utilized in the past as truck parking and storage for the commercial use of Dayl Graves Truck sales and leasing. The subject property has limitations on development for any primary residential use due to the lack of frontage on public streets, overall site accessibility and the separation by the railroad tracks. During the review, staff recommended the inclusion of the property at 1102 South 9th Avenue, which is owned by Tim Watson. The Tim Watson property, 1102 South 9th Avenue property, is adjacent to the Houk property and is located north of the Mister Car Wash area. This property was subject to a boundary line adjustment in 2017, which increased the parcel size and included an additional 46,967 sq. ft. of land that was designated as a Commercial land use. The remaining northern area consists of 32,406 sq. ft. and has a Residential land use designation. The property is currently under a Highway Commercial designation under the provisions of Walla Walla Municipal Code 20.02.060 B. Lots Divided by Zone District Lines. Wherever a single lot two (2) acres or less in size is located within two (2) or more different zoning districts, the district regulations applying to the larger portion of the lot shall apply to the entire lot. Good planning principles would not leave a sole property remaining, with a land use designation of residential, surrounded by the adjacent commercial. The property, house and outbuildings can remain a residential use until such time the use is abandoned or terminated. The City of Walla Walla Planning Comission conducted a Public Hearing for the amendments on Monday, September 9, 2024. At the Public Hearing, the Planning Commission received verbal public comment from Mr. Houk. No written letters nor other testimony was received on the proposal. The Planning Commission recommend approval of the Comprehensive Plan Land Use Map Designation change from Residential to Commercial and the rezone from Multi-family Residential to Highway Commercial for all of the subject properties. October 7, 2024: City Council held a work session to discuss these proposed amendment.
POLICY ISSUES:
Land Use Policy 1.1: Accommodate new residential and commercial development in areas with available infrastructure and services. Land Use Policy 1.4: Review new development proposals to ensure they support the objectives of the Comprehensive Plan such as land use, transportation, community character, historic preservation, and sustainability. Land Use Policy 1.5- Establish future land use and zoning designations that minimize and mitigate potential land use conflicts. Land Use Policy 4.1- Balance commercial, industrial, and residential development with the conservation of natural resources and open space by directing growth to areas already served by infrastructure. Economic Development Policy 3.1 Encourage the development of employment choices with business stakeholders in the community.

HISTORY:
In accordance with Walla Walla Municipal Code (WWMC) Section 20.02.130, the Development Services staff and the planning commission is charged with reviewing the zoning code periodically and report to the City Council on proposed amendments. This years proposed code amendments seek to revise and update sections of the WWMC to improved clarity and usability for the public, and for staff, to implement policy changes, to remove and update outdated language, and to ensure the WWMC continues to meet the needs of the community without creating confusion or redundancy. The following proposed code amendments have been reviewed by staff and the planning commission, both of which recommend approval. Walla Walla Municipal Code Text Amendments to Title 5: Business Licenses and Regulations, Title 19: Subdivisions, and Title 20: Zoning to implement the Walla Walla Comprehensive Plan 2040. The proposed code amendments would apply City-wide. Amendments are proposed to the below Municipal Code Chapters. The proposed amendments are detailed further in red-line track changes in the documents attached to this agenda report. Chapter 5.04 Mobile Vendors Clean up of language that is no longer applicable and clarification of requirements for mobile vendors. Chapter 19.30 Subdivision Design Clarification of standards relating to streets designated as “drive” or “way”. Chapter 20.02 General Provisions Adds a second annexation petition period so that there is one in January and a second in July. Chapter 20.38 Closed Record Decisions and Appeals Clarification of the route that shoreline permit decisions may be appealed. Chapter 20.100 Tables of Permitted Land Uses Relating to Community Services, amends the level of review for Day Care Centers: Family (13 or more children) from a Level 3 to a Level 1 in the Public Reserve (PR), Central Commercial (CC), Highway Commercial (CH), and Light Industrial/ Commercial (IL/C) zoning districts. Relating to Retail Trade and Service, this code change proposes permitting kennels under requirements specified in Chapter 20.130 Animals in the following zoning districts: Public Reserve (PR), Central Commercial (CC), Highway Commercial (CH), and Light Industrial/ Commercial (IL/C). Relating to Retail Trade and Service, this code update adds Mobile Vendor Food Court to the Table of Permitted Land Uses and proposes a Level 2 use in Central Commercial (CC), Highway Commercial (CH), Light Industrial/ Commercial (IL/C), and the Airport Development District (AD). Chapter 20.102 Site Design, Density, and Dimensional Regulations Adds a section relating to Residential Covered Rear Patios and allowances for extending into the rear yard setback. Chapter 20.123 Table of Permitted Home Occupations Adds mental health professional and massage therapist to the table of permitted home occupations. Chapter 20.130 Animals Removes the requirement that structures and runs are no closer than 100-feet from residential dwelling units on neighboring lots; clarifies that criteria shall be considered for every proposed animal kennel, not just conditional use permits; and adds a section relating to the level of review for an animal kennel based on the distance from property lines. Spring 2024: Development Services staff began initial discussions and review of the draft code amendments. July 1, 2024: The Planning Commission reviewed preliminary draft code changes at the July 1, 2024 workshop and provided feedback to Development Services staff. July - August 2024: Development Services staff revised the code amendments based on Planning Commission's input and performed research to further refine the proposed code changes. August 5, 2024: The municipal code text amendments application was submitted, and the code updates formally initiated. The State Environmental Policy Act (SEPA) checklist was also submitted on August 5, 2024. August 12, 2024: The Notice of Application/ Notice of Public Hearing was posted on the City of Walla Walla website on August 12, 2024. A SEPA Determination of Non-Significance (DNS) was issued on August 12, posted on the City’s public notices webpage, uploaded to the Department of Ecology’s SEPA Register, with a comment period that ended on August 28, 2024. August 13, 2024: Pursuant to RCW 36.70A.106, the 60-day notice of intent to adopt code changes was submitted to the Washington State Department of Commerce and the acknowledgment letter was received on August 13, 2024. August 28, 2024: The Notice of Application and SEPA comment period deadline. No public comments were received. September 9, 2024: The Planning Commission held a public hearing and recommended approval of the code updates as written, with one addition or clarification relating to animal kennels and the minimum distance from residential units. The Planning Commission wished to add clarification that the minimum distance from residential units applies to residences on lots neighboring a kennel. No public comments were received during the public hearing. October 7, 2024: City Council reviewed the proposed 2024 municipal code changes at the October 7, 2024 work session and provided feedback to Development Services staff.
POLICY ISSUES:
The proposed code amendments shall revise and update sections of the Municipal Code to improve clarity and usability for the public and for staff, to implement policy changes, to remove and update outdated language, and to ensure that the Municipal Code continues to meet the needs of the community without creating confusion or redundancy.
PLAN COMPLIANCE:
COMPREHENSIVE PLAN: The proposed code revisions are supported by the Walla Walla Comprehensive Plan – Walla Walla 2040 Goals and Policies, as follows: Community Character Goal 2: All of Walla Walla’s residential communities are livable and attractive. Land Use Policy 1.2: Annex and provide services to all lands within the Urban Growth Area. Land Use Policy 1.3: Encourage infill development that provides additional housing in the city. Land Use Policy 1.5: Establish future land use and zoning designations that minimize and mitigate potential land use conflicts. Land Use Goal 3: There are a variety of uses allowed throughout Walla Walla that encourage options for housing and business. Economic Development Goal 4: Walla Walla has a supportive environment for entrepreneurial opportunities and startup businesses. Economic Development Policy 4.1: Support home-based business and occupations by reviewing and implementing rules that are current and adaptive to new technologies. Economic Development Policy 4.3: Walla Walla offers a high quality of life for entrepreneurs, their families, and employees.
ALTERNATIVES:
Approve, deny or approve with modifications to the proposed code amendments.
STAFF RECOMMENDATION:
Staff recommends adoption of the proposed ordinance approving the Planning Commission’s recommendation.

HISTORY:
The City was informed that the property located at 1212 W. Moore Street, was for sale. The property is located directly south of the Sleep Center. The property was originally on the market for $149,000, but the owner would accept the City's offer of $125,000. The property has been a problem for Code Enforcement as it is frequently in need of clean up. The property could be used to expand the Sleep Center in the future.
POLICY ISSUES:
The Sleep Center is a low barrier shelter. This shelter meets the needs of the some of the hardest to care for in our community. Exit Homelessness program operates at the Sleep Center. The philosophy behind both the Sleep Center and the Transition Area is a “housing first approach”, in that the need for housing must be addressed before most individuals can actively and successfully engage in treatment and address other major life challenges.
PLAN COMPLIANCE:

COMPREHENSIVE PLAN: Housing Goal 1 A broad range of housing choices is available to meet the needs of people of diverse socioeconomic status, household type, and age. HISTORY:
Walla Walla City staff, on November 12, 2020 staff held a pre-application meeting with representatives of Cottonwood Investors, LLC to discuss possible residential development of approximately 104 acres of unincorporated land located south of Walla Walla City limits between Cottonwood and Kendall roads. Cottonwood Investors, LLC gave notice to the City on January 5, 2021 of its intention to commence annexation proceedings. Cottonwood Investors, LLC filed an application for a development agreement on April 1, 2021. The Walla Walla City Council passed City Resolution 2021-65 on April 28, 2021 determining that the City would conditionally accept annexation of the property conditioned upon the owner of the property entering into a development agreement with the City of Walla Walla. City staff and Cottonwood Investors, LLC negotiated a proposed development agreement. The Walla Walla City Council passed City Resolution 2024-80 on August 28, 2024 setting a hearing date and establishing the process for consideration of the proposed development agreement. The Walla Walla City Council conducted a public hearing on September 23, 2024. The Walla Walla City Council deliberated on October 9, 2024 and by verbal motion disapproved the proposed development agreement.
STAFF RECOMMENDATION:
Consider the proposed resolution memorializing the verbal motion to disapprove the proposed development agreement.
